1. Agreement to Terms
By accessing or using the services of Swift Intercom Pty Ltd ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services Description
Swift Intercom provides telecommunications and IT infrastructure services including but not limited to: fiber optic installation, IT infrastructure solutions, security systems installation, BTS installation, site surveys, and equipment supply. All services are subject to separate service agreements and quotes.
3. Quotes and Proposals
All quotes and proposals provided by us are valid for 30 days unless otherwise stated. Prices are subject to change based on:
- Changes in project scope or requirements
- Site conditions not disclosed during quoting
- Equipment availability and pricing fluctuations
- Regulatory or compliance requirement changes
4. Project Execution
Project timelines are estimates based on information available at the time of quoting. We will:
- Provide estimated start and completion dates
- Communicate any delays as soon as practicable
- Require client cooperation for site access and approvals
- Not be liable for delays caused by factors outside our reasonable control
5. Payment Terms
Payment terms are as specified in individual service agreements. Generally, we require:
- A deposit before project commencement
- Progress payments as milestones are achieved
- Final payment upon project completion and acceptance
- Payment within 14 days of invoice date
6. Warranties
We warrant that our services will be performed in a professional and workmanlike manner. Equipment warranties are as provided by the manufacturers. Our workmanship warranty period is 12 months from project completion unless otherwise specified.
7. Limitation of Liability
To the maximum extent permitted by Australian law, our liability for any claim relating to our services is limited to the amount paid for the specific service giving rise to the liability. We are not liable for indirect, consequential, or incidental damages.
8. Intellectual Property
All designs, documentation, and materials created by us remain our intellectual property until full payment is received. Upon payment, clients receive a license to use documentation for the specific project purpose.
9. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.
